About same time last year we had different "schism" on these forums: July 2007 filers with approved labor who could file their 485s Vs those with older PDs but unfortunately stuck in BECs.Most of Eb3s who are outraged today are July 2007 filers.Any guesses how many of them requested BEC victims back then "to be happy" for others and not rock the boat?
The unfortunate fact is that although everyone here is convinced of their moral high ground it is nothing more than self-preservation at the end.If it was just that it would still be fine (human nature) but still more unfortunate is the fact that we as a group never get this riled up - except few notable and respected exceptions - as long as everyone is equally miserable.Only if we had so much participation in all action items (admin fixes, house bills, funding drive etc.)...

I agree, the conflict discussed here is a political conflict.It could have been resolved much easier if all sides stopped looking at it with the religious-end-of-times lens (jews: nile-to-euphrates empire belonged to us 3000 years ago, christians: jews from all over the world must be transfered back there for the messiah to return..and muslims: end of times won't come until jews fight the muslims and we beat them)..

Why do you need to hire other person if Joe is fit f
or the job though he is not as bright as other H1b person.For example you do not need IIT graduate for QA position.For example If you want a core system software programmer in TCP/IP level or semiconductor R&D you can go brightest in the World.Bill Gates is an exception.95% of bright people will have degree or more in current world.
I am sorry to hear this sense of mediocrity that you want to perpetuate - maybe, I made a mistake by preaching to the wrong set of folks.The person I want to hire for a particular position should be smart enough to move to other positions (if the original position were to go away or if his/her career plans were to change).The last thing I want is to hire a person whose skills are not transferrable to a different job position.
I have myself moved from development to management to business and all because I believe I have the base skills to be an effective, valuable employee (and alas, every time I have done the change, my GC has been re-applied).
In a competitive world, you are better off hiring the best talent - just pay close attention to the kind of folks McKenzie/BCG hires.

Anyhow there are more chances for increasing H1b numbers at this situation with some restrictions(Our Indian companies will easily find a looph*le for any law).Banning of H1B for bodyshopping or consulting will be impossible.Wait and watch for how CIRcus unfolds for next few weeks.
Of course I don't work for a consulting company.And if I did I wouldn't be here UNLESS I WAS EMPLOYED 100% FROM DAY ONE.

Folks, it is indeed sad that perfect is turning out to be the enemy of good here, metaphorically speaking.
Surely if the powers-that-maybe turn out to be antagonistic to highly skilled legal foreign workers in this country, it is a given that they are likely to turn this country into a place where none of us ever wanted to be.
America has always been about opportunity for the smart and hard workers regardless of their background.It has attracted people because they saw their future brighter here.Take that away and not much else gets left behind.
I have been in this country for 6 years now and still do not have more than a toehold here despite having put in my tax dollars which in some small fraction have helped pay for what some (who knows) people born here required help with getting.Moreover, if allowed to remain here, my project will yield for this country and the world a device that will help people save their eyesight.

Let us be honest.A lot of us who came through body shops had to pay lawyer fee or had to take a cut in pay.Many of us had to sit in the bench for a long time with out pay.At the end of the day, not all of us are the best and the brightest but we are ready to work harder than the average Joe.With or without us this country will go forward.We are here to get a greencard and to become part of the melting pot.Please admit it my friends.I fully understands why many Americans are against us.We simply take their job.Then we insult them.Then we say, if we go back the American economy will go to hell.The companies are here for cheap labor.The congressmen who support them are the biggest receivers of their contribution.That is the reality.Let us not forget that.:D

I wish Obama wins.His team has more clarity on many issues and he has the zeal like JFK for making things happen.But, a big but - I am very concerned about our Employment Based immigration.If he gets to win (I wish he does..as someone who want to see America regain it's global position not just with might but also being morally right), I am worried if it would be Sen.Durbin who will dictate the immigration policy.
I wish we get some clarity in this aspect.In the economic downturn, I wish to work more than I ever did and see that US comes out of recession fast.But for that I have to be inside the country first.I have to be given a fair chance to contribute to this economy first and I need to be treated with respect and honor.

I am a big supporter of Obama and a big fan and am eagerly looking forward to see him as our next President of United States.As a legal highly skilled immigrant what can I expect?Well, not sure if I would see myself living here anymore.I have been in the green card queue for more than 8 years now and still waiting.Will Obama's administration do anything for people like me to help reduce backlog?I doubt such a thing will ever happen.I would see myself and people like me discouraged and start packing our bags and move on with life.
Why do I feel discouraged?If anything is going to happen for the immigrant community when Sen.Obama becomes the President, it is going to be in the lines of CIR 2007.There would be provisions to make illegal immigrants as legal and remove backlogs to family based quota whereas posing harsh restrictions on H1b visas and reducing Green Card quotas and scrap AC21 portability and try to experiment with some new kind of skilled immigration system.
The above is very evident based on the fact that Senator Durbin has been very hostile to EB immigrants.It is evident that Senator Durbin will make the calls when Senator Obama becomes the president.
Please post your opinions.This is a very important discussion.It is very important that the community see what is in store for us when the new Administration takes charge.

I agree that there is general perception floating around which suggests that Democrats would not support EB.
But I have feeling that in teh dog eats dog world no one does favor on any one.when they say amensity for illigal immigrants there is some interests as polictal parties look for vote bank.
Lets a*sume that if Obama would be in power I guess in that case surely they will have to sing diffrent tune ( if we a*sume that they are completely against immigration which I doubt) as country has to give enough consideration to the fact that US needs foriegn workers.With such economy no one can ignore that if we don't encourage GC process there would be reverse brain drain.Companies like Microsoft has already started moving some operations in canada and other countries to accomadate foreign workers.Yes they would not do for you and me but they will have to do for strong business communities.
I really like the point mentioned here if you allow me I can forward this to Obama campaign for clarification on this..

now i will get three yr ext with I 140 cleared
then i can get new i 94 with stamping
